Terms of sale

These terms apply to everything sold through cavyconcepts.co.nz. Please read them before you send an order request.

Who you are buying from

Cavy Components is a sole trader business. It is me, Carl Cavanagh, working out of Tauranga, New Zealand. I design and machine the parts myself.

Email is the only way to reach me, and it is how every order is confirmed. I do not publish a street address. If you are picking up, I email you the address once your order is confirmed.

Prices and GST

All prices on the site are in New Zealand dollars and include GST at 15%.

I am registered for GST. GST number: [TO BE SUPPLIED]

The Custom Sprocket is listed as “From $200.00”. The final price depends on how complicated the design is. I confirm the exact price by email before you pay anything.

Prices can change without notice. The price that applies to your order is the one in my confirmation email, not the one showing on the site at the time you sent the order request.

How ordering works

There is no online payment on this site. Nothing is charged when you place an order. No card details are taken at any point.

  1. You add parts to the cart and send an order request.
  2. The site immediately emails you an order reference and my bank account details.
  3. I reply to confirm what is actually available, the final price, and the shipping cost, or that you are picking up.
  4. You pay by bank transfer after that confirmation.
  5. I pack or make your order, and post it or arrange pickup.

Please do not pay until you have my confirmation. The automatic email includes my bank details so you have them ready, but your total is not final until I have quoted the shipping.

When a contract is formed

An order request is an offer to buy. It is not a completed sale and it does not commit either of us.

The contract forms when I email you to confirm your order. Until then I can decline all or part of an order request, for example if a part has sold, if a price on the site was wrong, or if I cannot make a timeframe you need. If you have already paid for something I cannot supply, I refund it in full.

Availability changes. Parts are machined in small batches, and stock can sell between the time you send an order request and the time I read it. Items that are out of stock or made to order show a contact button instead of an add to cart button.

Payment

Bank transfer only, to a New Zealand bank account. No cards, no payment plans.

Your confirmation email carries a short payment reference in the form CC-XXXXXX. Put that in the payment reference field so I can match your payment to your order. It is deliberately short because a New Zealand bank payment field only holds 12 characters. If the reference is missing, your order can sit unmatched until I work out who it came from.

If I do not receive payment within [TO BE SUPPLIED: days a confirmed order is held] of confirming your order, I may release the stock to someone else and cancel the order. Just email me if you need longer.

Ownership of the goods

The parts stay my property until your payment has cleared into my account in full. Ownership passes to you once it has.

That does not change my responsibility for getting your order to you in acceptable condition, which is covered by the Consumer Guarantees Act 1993 and explained on the refunds and returns page.

Shipping

Shipping is not calculated on the site. I quote it when I confirm your order, based on where it is going and the size and weight of the parcel. You pay it with the rest of your order.

Shipping is within New Zealand only. International shipping is not set up yet.

Any delivery timeframe I give you is an estimate, not a guarantee. Once a parcel is with the courier, the timing is up to them. I will pass on tracking where the courier provides it. Please give me a delivery address where someone can take the parcel, and tell me in your order notes if anything about the delivery is unusual.

Pickup from Tauranga

You can pick up from Tauranga by arrangement. Say so when you send your order request, or in your reply to my confirmation, and I will email you the address and a time once the order is confirmed and paid. Pickup is free.

Made to order and custom work

Some parts are made in batches and can run out. When something is unavailable, the product page shows a contact button. Email me and I will tell you when the next run is due.

Made to order parts usually take [TO BE SUPPLIED: lead time for made to order items] from payment. Custom machining and custom sprockets usually take [TO BE SUPPLIED: lead time for custom work] from the point where we have agreed the design. Both are estimates and I will give you a realistic date with your confirmation.

For custom work I need the specification agreed in writing by email before I start cutting: sizes, tooth counts, fitment, and finish. Please check that specification carefully, because once a part is machined to it I cannot resell it. Custom and made to order parts cannot be returned because you changed your mind. Your rights if a part is faulty or does not match what we agreed are not affected, and are set out on the refunds and returns page.

Invoices

The order request email and my confirmation email are not GST invoices.

If you need taxable supply information, which is what a tax invoice is now called, email me with your order reference and I will send it through.

Fitting and use

BMX parts take a lot of load, and brakes matter. Please have parts fitted by someone who knows what they are doing, use any torque figures I give you, and check fasteners regularly.

I cannot take responsibility for damage caused by incorrect fitting, over-tightening, modification, crash damage, or normal wear. That is separate from a part being faulty when I supplied it, which is covered on the refunds and returns page.

My responsibility to you

I am one person making parts in a small machine shop, and my liability is limited to match. If something I supply causes you loss, my responsibility is limited to the amount you paid me for the goods concerned.

I am not responsible for indirect or consequential loss, such as lost income, travel or freight costs, a missed race, or the cost of other parts or labour, unless the Consumer Guarantees Act 1993 says otherwise.

Nothing in these terms limits or excludes your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Where those Acts give you a stronger right than these terms do, the Act applies.

Your rights under New Zealand law

If you are buying as a consumer, your Consumer Guarantees Act rights cannot be contracted out of, and nothing on this site tries to.

If you are buying for business purposes, and both of us are in trade, the Consumer Guarantees Act allows us to agree in writing that it does not apply. I do not apply that exclusion by default. If it ever applies to an order, it will be written into that order’s confirmation email and you will have agreed to it before you pay.

Your information

The site has no accounts and no order database. Your cart is stored in your own browser and never sent anywhere else until you submit an order.

What happens to the details you type into the order form, who processes them, and how long they are kept is set out in full on the privacy policy.

Governing law

These terms are governed by New Zealand law. Any dispute is dealt with in New Zealand, whether through the Disputes Tribunal or the New Zealand courts.

Changes to these terms

I can update these terms at any time. The version published when you send your order request is the one that applies to that order.
